Official Rules

The American Legion, Department of Florida 50/50 Freedom Raffle (the “Raffle”) is sponsored by The American Legion, Department of Florida, Inc., a 501(c)19 nonprofit organization (EIN: 59-0142062) located at 1912A Lee Road, Orlando, FL 32810. The mission of the Raffle is to support the charitable efforts of the various programs and services of the American Legion, Department of Florida (“Florida Legion”) throughout the State of Florida.

No contribution or donation is necessary to enter to win. Void outside of the promotion area and where prohibited by law. All disputes will be resolved solely by binding arbitration and entrants waive the ability to bring claims in a class action format. The Raffle is offered only within the State of Florida (“the Promotion Area”). Void outside the Promotion Area and where prohibited.

Eligibility

U.S. residents 18 years or older and present in the Promotion Area at the time of entry are eligible to enter. Employees of The American Legion, National Headquarters, and The American Legion, Department of Florida, Inc., and their family members and household residents, are not eligible to enter. Void where prohibited.

How to Enter

To enter the Raffle, an eligible entrant must acquire a ticket during the draw period from the Rafflebox website (www.florida5050.org). Each ticket will be unique to the purchase and those numbers shall be used to determine the winner of the Raffle. Each ticket is valid only for the Drawing corresponding to the current draw and Entry Period during which such Raffle Ticket was obtained. Non-winning Raffle Tickets are void and will not carry over to any subsequent raffles or drawings. Raffle Ticket donations are not tax deductible, and no refunds will be made, except as otherwise determined by the Florida Legion in its sole discretion.

Raffle tickets will be available starting Wednesday, February 21, 2024 at approximately 1:00 PM EST and ending on Sunday, March 31st, 2024 at approximately 11:59:59 PM EST. Presale tickets will include additional entries and will end on Friday, March 4th at approximately 9:00 AM EST.

The main winner will be selected on April 1, 2024 at 9:00 AM EST. Six (6) Lucky 7 Winners will be selected on March 7, March 11, March 18, March 21, March 25, and March 28th at approximately 3:00 PM. In honor of the American Legion’s 105th Anniversary, seven (7) additional Legion Birthday Winners will be selected on Friday, March 15th for seven consecutive hours starting at 9:00 AM EST. The more tickets you enter, the higher your chances are to win a cash prize.

*Lucky 7 Winners will receive a guaranteed prize of $700. Legion Birthday Winners will receive a guaranteed prize of $105. April 1st Main Draw winner will receive half the total prize pool! 

There are two (2) ways to obtain Raffle tickets:

  1. Online Sales: You may obtain Raffle tickets online at the Raffle page (http://www.florida5050.org) by following the instructions to complete the transaction and provide any required information;
  2. No contribution or purchase necessary (online): You may obtain a Raffle ticket without a donation by sending an email requesting an entry to donate@floridalegion.org with the following required information: Name, Address, Phone, and Email. If information is not provided, void where prohibited. Limit one entry per 24-hour period.

The suggested minimum contribution for the Raffle tickets is $10 for 7 tickets, $21 for 49 tickets, $42 for 214 tickets, and $98 for 777 tickets. Bonus entries will be available starting Wednesday, February 21, 2024 at approximately 1:00 PM EST through Monday, March 4th at 9:00 AM. During the presales period, bonus entries suggested minimum contribution for the Raffle Tickets is $7 for 14 tickets, $21 for 140 tickets, $42 for 420 tickets, and $98 for 777 tickets. Raffle ticket donations are not tax deductible and making a donation will not increase your chances of winning.

IMPORTANT: MESSAGE AND/OR DATA RATES MAY APPLY TO THE USE OF MOBILE PHONES/DEVICES TO PARTICIPATE IN THE RAFFLE. WIRELESS SERVICE MAY NOT BE AVAILABLE IN ALL AREAS. EACH WIRELESS CARRIER’S DATA RATE PLAN MAY VARY, AND YOU SHOULD CONTACT YOUR WIRELESS CARRIER FOR INFORMATION ON DATA RATE PLANS AND CHARGES RELATING TO YOUR PARTICIPATION IN THIS RAFFLE.

All Raffle Ticket sales and requests must include a valid daytime phone number or email address if requested for the entrant and the entrant remains solely responsible for notifying the Florida Legion of changes in his/her/their contact information.

If you participate in the Raffle online, you agree that the information that you provide in connection with the Raffle may be used by the Florida Legion in accordance with the Privacy Policy (detailed below).

Determining the Winner

To become an Official Winner: (1) must be eligible to participate in the Raffle under these Official Rules and must not be in violation of these Official Rules as determined in the organization’s sole judgment; (2) the Potential Winner must submit a completed W9 tax form and two forms of identification (to satisfy the IRS requirements necessary to complete the annual W-2G form). If for any reason whatsoever all of the foregoing requirements are not satisfied with respect to a particular Potential Winner or is unable to be confirmed the holder of the Winning Ticket, then that Potential Winner will be deemed disqualified. The organization shall use the following rules to determine the identity of any Potential Winner and of the Official Winner of each Prize: the organization shall conclusively presume that the person who is in possession of the Winning Ticket is the lawful owner of that Ticket and that Ticket’s Winning Number, and the organization shall not make, nor have any duty to make, any inquiry whatsoever into the circumstances under which that person came into possession of such Winning Ticket.

The winning ticket will be determined by a random draw utilizing a Gaming Laboratories International (GLI) certified random number generation application. All tickets, each containing a unique ticket number will be emailed to ticket purchasers by the registered Electronic Raffle Supplier (ERS) (Rafflebox). A physical ticket will not be mailed out for this draw.

The winner will be notified by phone and email. The winner has 60 days to claim their prize. Draw results will appear under the “Winners” tab found on the main raffle page. Entrants do not need to be present to win. Forfeited Prizes may be retained by the Florida Legion for charitable use.

Prizes & Odds

Upon compliance with these Official Rules, the official winner shall be entitled to receive fifty percent (50%) of the Net Raffle Proceeds (defined below) to be paid to the winner via check by the Florida Legion. A Potential Winner must provide the organization with all tax identification information required by federal, state, or local law and, where applicable, provide the organization with payment for any required withholding taxes due prior to that Potential Winner’s receipt of the Prize. If the Prize was more than $600, the Raffle Winner will receive on or before January 31st of the immediately following calendar year a W-2G federal income tax form setting forth the amount of the Prize and the Withholding Amount (if any).

Net Raffle Proceeds shall mean the total Raffle proceeds collected through Raffle ticket donations during the Raffle less ten percent (10%) to cover transactional fees, staffing, and other equipment-related costs.

The winner(s) assumes sole responsibility for all expenses and incidental costs associated with accepting or claiming the prize not expressly included in the prize description above, including without limitation, all federal, state, and/or local taxes, including sales, use, and income taxes (if any), any transportation to claim the prize, fees and/or other items.

Winners may be required to complete an affidavit of eligibility if you are chosen as the winner of the raffle. By returning your raffle tickets, you agree that your name will be included in the list of winners published on our website and social media, if you are selected as a winner of the raffle. Late entries received will be processed as general donations.

The winner will be issued any Internal Revenue Service (“IRS”) tax forms or other required documentation and/or reporting forms for the ARV of the prize awarded if required. The winner is solely and exclusively responsible for all state, federal, or local income taxes that may result from his/her/their acceptance of the prize. The Florida Legion is required by law to withhold and remit to the IRS on the winner’s behalf an amount equal to twenty-four percent (24%) of his/her/their prize awarded (the “Withholding Amount”) if the value of the prize exceeds $5,000 and the winner is a citizen or resident alien of the United States with a Social Security number (different rules as promulgated by the IRS apply for nonresident aliens and for resident aliens and citizens of the United States who do not have a Social Security number) or as otherwise required by law. Failure to comply with any of the rules on this page may result in disqualification.

If you submit an incorrect address or phone number and we are unable to contact you, your prize notification is returned or you don’t respond to the notification within 15 days, your cash prize will be forfeited.

Privacy Policy

The Official Winner agrees that acceptance of the Prize grants to the organization and the organization’s designees and affiliates, the right to print, publish, broadcast, and use worldwide and on the Internet, in any media now known or hereafter developed at any time or times, the Official Winner’s name, portrait, picture, voice, likeness, biographical information, and Prize information for any purpose, including but not limited to in advertisements, trade and promotional purposes, publicity, and other communications without additional compensation, in perpetuity, without notice, review, or approval, except where prohibited by law.

Disputes

Except where prohibited by law, by participating in the Raffle, you expressly agree that (a) all disputes and causes of action arising out of or connected with the Raffle or the prize shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules in Orange County, Florida; and (b) judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants or other participants, shall be governed by Florida law, without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than Florida.

By entering, accepting a prize and/or otherwise participating in the Raffle, you expressly agree that any legal proceedings not subject to arbitration and arising out of or relating in any way to this Raffle or these Official Rules shall be brought only in the federal or state courts located in Orange County, Florida, and you consent to the mandatory and exclusive jurisdiction in such courts with respect to any such legal proceedings.
